Son Kullanıcı Lisans Sözleşmesi (EULA)

Bu Son Kullanıcı Lisans Sözleşmesi ("EULA"), BKS Cam Sanayi ve Ticaret A.Ş. ("Lisans Veren") ile BKS Messenger uygulamasını indiren ve kullanan kişi ("Lisans Alan") arasında yapılmıştır.
1. Lisans Hakkı
Lisans Veren, Lisans Alan'a BKS Messenger uygulamasını kişisel cihazlarında kullanması için sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans vermektedir. Bu lisans:
- Yalnızca uygulamanın amaçlanan kullanımı için geçerlidir
- Ticari alt lisanslama hakkı içermez
- İşbu sözleşme koşullarına tabidir
2. Kısıtlamalar
Lisans Alan aşağıdaki eylemleri gerçekleştiremez:
- Uygulamayı kopyalamak, değiştirmek veya dağıtmak
- Uygulamayı tersine mühendislik işlemine tabi tutmak, kaynak kodunu elde etmeye çalışmak
- Uygulamadaki telif hakkı veya mülkiyet bildirimlerini kaldırmak
- Uygulamayı yasa dışı amaçlarla kullanmak
- Uygulamanın güvenlik mekanizmalarını atlatmaya çalışmak
- Lisansı üçüncü taraflara devretmek veya alt lisans vermek
3. Fikri Mülkiyet
BKS Messenger uygulaması ve tüm bileşenleri (kaynak kod, tasarımlar, grafikler, logolar, metinler ve diğer içerikler) BKS Cam'ın münhasır mülkiyetindedir. Bu sözleşme, fikri mülkiyet haklarının devri anlamına gelmez.
4. Güncellemeler
Lisans Veren, uygulamayı zaman zaman güncelleyebilir. Güncellemeler bu sözleşmenin bir parçası sayılır. Lisans Alan, en iyi deneyim için uygulamayı güncel tutmalıdır.
5. Garanti Reddi
Uygulama "OLDUĞU GİBİ" ve "MEVCUT HALİYLE" sunulmaktadır. Lisans Veren, uygulamanın kesintisiz, hatasız veya güvenli olacağına dair açık veya zımni hiçbir garanti vermemektedir.
6. Sorumluluk Sınırlaması
Lisans Veren, uygulamanın kullanımından veya kullanılamamasından kaynaklanan doğrudan, dolaylı, arızi, özel veya sonuç olarak ortaya çıkan zararlardan hiçbir koşulda sorumlu olmayacaktır.
7. Sözleşmenin Feshi
Bu sözleşme, aşağıdaki durumlarda otomatik olarak sona erer:
- Lisans Alan'ın sözleşme koşullarını ihlal etmesi
- Lisans Alan'ın uygulamayı cihazından kaldırması
- Lisans Veren'in sözleşmeyi feshetmesi
Fesih durumunda, Lisans Alan uygulamayı kullanmayı derhal durdurmalı ve tüm kopyalarını silmelidir.
8. Uygulanacak Hukuk
Bu sözleşme, Türkiye Cumhuriyeti kanunlarına tabidir. Uyuşmazlıklarda İstanbul Mahkemeleri ve İcra Daireleri yetkilidir.
9. İletişim
End User License Agreement (EULA)

This End User License Agreement ("EULA") is entered into between BKS Cam Sanayi ve Ticaret A.Ş. ("Licensor") and the person downloading and using the BKS Messenger application ("Licensee").
1. License Grant
The Licensor grants the Licensee a limited, non-exclusive, non-transferable, and revocable license to use the BKS Messenger application on personal devices. This license:
- Is valid only for the intended use of the application
- Does not include commercial sublicensing rights
- Is subject to the terms of this agreement
2. Restrictions
The Licensee may not:
- Copy, modify, or distribute the application
- Reverse-engineer the application or attempt to obtain the source code
- Remove copyright or proprietary notices from the application
- Use the application for illegal purposes
- Attempt to bypass the application's security mechanisms
- Transfer the license or sublicense to third parties
3. Intellectual Property
The BKS Messenger application and all its components (source code, designs, graphics, logos, text, and other content) are the exclusive property of BKS Cam. This agreement does not constitute a transfer of intellectual property rights.
4. Updates
The Licensor may update the application from time to time. Updates are considered part of this agreement. The Licensee should keep the application up to date for the best experience.
5. Disclaimer of Warranties
The application is provided "AS IS" and "AS AVAILABLE". The Licensor makes no express or implied warranties that the application will be uninterrupted, error-free, or secure.
6. Limitation of Liability
The Licensor shall not be liable under any circumstances for direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the application.
7. Termination
This agreement automatically terminates in the following cases:
- Licensee violates the terms of the agreement
- Licensee uninstalls the application from their device
- Licensor terminates the agreement
Upon termination, the Licensee must immediately cease using the application and delete all copies.
8. Governing Law
This agreement is governed by the laws of the Republic of Turkey. Istanbul Courts and Enforcement Offices have jurisdiction over disputes.
